What is Trademark Objection?
For various reasons, your trademark application can have the objection from trade Marks Office. This may be because it could hurt religious sentiments or if it is likely to cause confusion, word or logo is too similar to an existing trademark, various other reasons. Within a month from when the Examination Report has been published online response must be filed to the objection and a month from when it was received, if it has been sent to you or your lawyer. The Registrar could abandon the application altogether, if you don't file the response for objection.

Likely Clearance
The chance that your application will be cleared is high, if you respond with clear evidence regarding the distinctiveness of your trademark. Registrar only need a clarification, there's no reason for your application to be abandoned just because of the objection.

Brand Protection
You would have been using the ™ symbol for a few months, customers would have likely become accustomed to the brand name, by the time of the objection. New application filing would not make business sense, instead simply identify reasons your logo, slogan or brand name are different.

Process of Trademark Objection

1 Working Day
If your trademark has been filed with us, trademark objection information by the Registrar will be informed by us in less than a month from the publication of the Examination Report containing the objection. It's best you contact us within a month from the publication of the report, if you are not a customer.

6 Working Days
Our experts will be in touch with you, who will frame the correct response and affidavit (if required) on the ground of your case. The response will be submitted.

30 Working Days
If your initial response has not been accepted by the Registrar, an interview is scheduled, where the arguments need to be presented in person. The objection will be lifted within 18 months, if the government is satisfied with the response.
